Terms of Use

1. Using the App

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on Apple devices you own or control, in line with these Terms and the Usage Rules in Apple's Media Services Terms and Conditions. You must be old enough to form a binding contract in your country, or have permission from a parent or guardian.

2. What the App is — and is not

ShieldSurfing is a web browser with features intended to support more private browsing, such as private tabs, tools for clearing browsing data and tracker protection. These features help reduce the information kept on your device and some forms of tracking, but they cannot prevent all tracking and do not make you anonymous online. Websites, network operators and internet providers may still be able to see your activity. Features may change, be added or be removed over time.

3. Subscriptions

3.1 Purchase

Some features may be available only through an auto-renewable subscription bought via the App Store. The subscription options, their duration and price are shown in the App before you confirm a purchase. Payment is charged to your Apple ID account when you confirm.

3.2 Automatic renewal

A subscription renews automatically at the end of each period unless auto-renewal is turned off at least 24 hours before the current period ends. Your account will be charged for renewal within the 24 hours before the end of the current period.

3.3 Cancelling

You can manage or cancel a subscription at any time in your Apple ID account settings on your device (Settings → your name → Subscriptions). Cancellation must be done at least 24 hours before the renewal date to avoid being charged for the next period. Cancelling stops future renewals; access continues until the end of the period already paid for. Deleting the App does not cancel a subscription.

3.4 Free trials

If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription, where applicable.

3.5 Refunds

Purchases are processed by Apple, and refund requests are handled by Apple under its own policies. We are unable to issue refunds directly.

4. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in breach of the rights of others;
• copy, modify, reverse engineer or decompile the App, except where the law expressly allows it;
• interfere with or disrupt the App, its servers or networks;
• resell, rent or otherwise commercially exploit the App without our written permission.

You are responsible for the websites you visit and the content you access with the App.

5. Third-party content

The App lets you access websites and content operated by others. We do not control and are not responsible for third-party websites, their content, availability or privacy practices.

6. Ownership

The App, its design, software, name and logos belong to us or our licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

7. Privacy

Our handling of personal information is described in the Privacy Policy, which forms part of these Terms.

8. Disclaimer

To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will block every tracker or protect against every risk.

9. Limitation of liability

To the extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from or related to your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App or subscription during the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer protection rights.

10. Suspension and termination

You may stop using the App at any time by deleting it and cancelling any active subscription. We may suspend or end your access if you seriously or repeatedly breach these Terms. Sections that by their nature should continue after termination will continue to apply.

11. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to it. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law

These Terms are governed by the laws of [TO FILL: jurisdiction], without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

13. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date, and significant changes may also be announced in the App. If you continue to use the App after changes take effect, you accept the revised Terms.
